I think you can employ any one on 1090 on temporary basis(nanny or home improvement, reapir etc) , not employ by start a company. Ask a lawyer.
Folks
Would anyone of you know whether someone on H1B can go ahead and hire a US citizen and be their employer? I know some people do hire nannies. How about for other everyday occupations?
Thanks and best regards.

As long as the Master Program in UK is equivalent to Masters in US, you should be good.
You can get your credentials evaluated in US and see if its a Masters equivalent.

I had infopass appointment yesterday at Dallas. I am waiting for my FP (Check my signature). It was rather simple. They checked the id and the appointment at the outside window and issued a token for me and my spouse (I went alone but took appointment for 2). By the time I cleared security and went inside I already had my token number announced. The IO asked me the reason I was visiting and she checked the 485 notice, punched in something in her system and said you should receive your FP notice within 30 days. She did same for my spouse. I was in and out of the building in 10 mins.

Hi,
Following are my USA stay details on L1 and H1-B visa:-
1) Stayed in USA from 01-SEP-2003 till 25-JAN-2004 on L1 visa(expired now).
2) Stayed in India from 26-JAN-2004 till 01-NOV-2004.
3) Stayed in USA from 02-NOV-2004 till date on new H1-B visa(still valid).
I read somewhere that 6 year period for H1 also counts L1 stay. Can someone please suggest, what should be my H1's final expiry date based on above details? Will that L1 stay be counted, even though I went back to India and came on a new H1-B visa?
Thanks,
Suneel.

I am a USC living in Jordan with my Jordanian husband, he was approved to apply for SB-1 visa ( because of his expired green card) and was sent the IV packet, which included the affidavit of support, just wondering how I'm going to fill the form since I don't work (never have) and live in Jordan with my husband, I was told I should fill out zeros where numbers are required and write unemployed where asked about work, is this the case? I will have a joint sponsor who is my brother in law who is a USC living and residing in the US, will this work? Please help as I couldn't find any answers on the net ( and I have been browsing all day!)

Hi all,
I am in a strange situation-- I have 2 different PDs.
1) PDs on my I-140 is listed: June 30, 2005 (which became current as of 2/11/2011)
2) I recently discovered a different PD listed on the Request for Initial Interview Notice (for my pending I-485). There is a Priority Date box on this notice letter, and date listed is Aug 16, 2007.
Biometrics done Nov2007
Initial Interview done June 2010
FingerPrint done August 2010
Currently on 3rd EAD
Nationality is Taiwan
Current status: AOS pending
I am torn and confused because 2 PDs are 2 years apart. Does any one have the same issue like me? What should I do??? Which PD is the correct one I should go with?? Please help! Thank you so much in advance for your time.

Hi
My wife who is currently working as a doctor in medically underserved area(J1 waiver case), on cap exempt H1B visa. Her clinic is contemplating name change. I will really appreciate if someone can shed the light on how might this proposed name change can/will impact her status?
Her visa is currently unstamped and we are planning to get the same done this year in october. My queries are as follows:
1. Will a new waiver petition and H1B visa need to be filed or only an addendum notification to the USCIS will suffice?
2. If the latter is true then what kind of additional documentation will be needed for visa stamping from the lawyer?
Attorney input will be highly appreciated.
regards

Folks,
I hate to start another thread, but judging by the number of separate threads on I-485 interviews, I thought if it makes better sense to have a common pool where we can ask questions and share experiences on these (supposedly) tense faceoffs. Our lawyers often charge a fat fee to babysit us at these interviews (I'll have to shell out $1000+travel costs for each such trip of my lawyer, a decent bloke otherwise). So it will be nice to know a little bit about these meetings (documents they ask you to bring along, questions they ask, how they behave etc.), that is, if we really need such expensive nannying, or can handle them by ourselves. So, please add your question/experience.
Thanks.

My friend Dan Kowalski linked today to an article in the Detroit Free Press about Naji Chammout, a Lebanese native who has been waiting on his citizenship application to be approved for ten years years. That might surprise people when they learn that Chammout volunteered for the US Army in 2004 when he was a green card holder and served as a translator to top American military commanders in Iraq. He sold his Louisiana gas station for the chance to serve his adopted country and went to some of the most dangerous places in the war zone. US Army Brigadier...

Really disappointing. Senator Schumer says on the one hand that the targeted companies are not violating the law and on the other says they are underpaying their workers - which would be a violation of the law. Which is it? And he disparages the entire staffing industry - an industry that in the US employs far more American citizens than immigrants - by questioning the legitimacy of the business model and complaining that these companies don't make anything. I'd remind Senator Schumer that most physicians at America's hospitals work for medical groups which are glorified staffing companies. Same for a...

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.

A new study by the Transactional Records Access Center (TRAC) finds that the nation's Immigration Courts are becoming increasingly backlogged. Our country's 234 immigration judges received over 350,000 new cases last year, almost 1,500 cases per judge. Coupled with the government's onerous "case complete goals", this brings incredible pressure on overworked immigration judges to issue decisions. As a result of the increasing backlog of cases, persons in detention may have to wait many months to challenge the legality of the charges against them or to have their asylum and other claims heard before a judge. The Bush Administration had promised...

The country's best known Hispanic GOP politician, Florida Senator Mel Martinez, announced this morning that he would not be returning to the Senate after the August recess ends. Martinez had already announced he was retiring in 2010 and it is not clear why he accelerated his departure. Martinez has been a consistently pro-immigration voice and he has criticized his party numerous times for alienating Hispanic voters. Many say that this criticism led to his being replaced as the chair of the Republican National Committee a couple of years ago. Florida Governor Charlie Crist and state legislator Marco Rubio have already...
