Hi everyone
I just got off the phone with USCIS and I thought I should share this with you. I received an appointment notice regarding fingerprints (for 10/20/07) and I called USCIS to ask if I can reschedule it for an earlier date. They said that I could go to the local application support center (the same location that is on the appointment notice) any Wednesday and ask for service at that time. That way I don't have to wait 3.5 weeks just to get the fingerprints taken and I'll probably get my EAD by then.
I hope this works out for me.
If anybody had such experience, please share.

Hello,
I am on H1 B and wife is on H4. H1B is expiring in Nov 2009 and my employer is going to file for extn. My wife is currently doing her Masters on H4. Need some advise to here
1) If I apply for extn (H1 & H4) within next 2 weeks it will take atleast another 3 months before I will come to know the decision. Nowadays lot of H1B extensions are getting rejected. Will it be a good idea to move my wife's status to F1 and not apply for her H4 extn..?
or
2) Should I wait for my decision on extension and if it gets rejected then apply for F1
or
3) Apply both i.e. apply for extension and simultaneously for H4 to F1. Any issues with this approach?
I don't have constraints on paying fees on H4 or F1. All I want is my wife should be able to continue her studies. I am working in an Indian company, so even if my extn gets rejected, I will go back to and continue work, but still want my wife to continue studies.
Appreciate your help.

2) 2 Years Masters degree in science (M.Sc), Andhra University,India
3) Having 9 years of continuous software experience (prior to present employer)
Am I eligible to file Perm Labor under EB2 category?
The job with my company is EB2 eligible (Requirement is Bachelors degree and 7 years experience).
As per my education evaluation (done some time back for H1B), mentioned that my above 2 degrees are equivalent to Bachelors degree of science (BS) in USA.
Please provide your valuable suggestions/advices.

U.S. Customs and Border Protection has announced new fees for persons seeking authorization to travel to the United States under the Visa Waiver Program. The authorization is obtained prior to travel through the Electronic System for Travel Authorization (ESTA), and typically remains valid for two years. Beginning on September 8, 2010, the ESTA travel authorization will require a valid credit card for payment of a $14.00 fee. The purpose of the fee is to finance efforts to promote international travel to the United States, and cover operational costs associated with running the ESTA program. Individuals who already possess ESTA authorization do not need to pay the fee until it is time for them to reapply.

hello, i really need some one to clarify this information for me.
when i first started working with my company i did not have work authorization and basically said i am a US citizen, i never had any problems for 4 years, i am a permanent residence now and got my green card this year. the company now nows that i lied 4 years ago when i got hired and i was not allowed to work but am fully eligible to work now becaue of change in status to PR. can the company resubmit a new i9 form with the correct information and if i will be in any trouble with USCIS.
What is the law for someone who worked illegaly but got his or her status changed to PR.

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

If your old visa has not beenexpired at the time of re-entering . You will need to carry your new approved I-797. But your I-94 would have the expiration date as that of the expiration date as on your old Visa.
I had the same situation last year and the processing went smoothly at port of entry, but you may check for any chages in the regulations.

My H1 is expired and i am working in EAD now. I am going for vacation next week. I dont have valid I94 (as my H1 is expired, my I94 also expired), does it cause any problem when i reentry?
Does immigration give new I94 when we enter with AP? I appreciate your help.

Hi All,
I applied for my I485 during the July 07 fiasco and also for EAD/AP for me and my wife. I just renewed my H1B for another 3 years and my manager just said that since I have my H1B, I shouldnt renew my EAD/AP when it expires next year since it is quite an expense for the company. My wife is using her EAD for her current job and so that will still be renewed.
Just wanted to find out if there can be any issues if I dont renew just my EAD/AP?
Also after filing for the I485 in July 07, we did our Fingerprinting in Feb 08. We had not received FP notice and had to go through infopass to get FP done. Since then we've not received a renewal for FP again. I believe FP expires in 18 months and we need get it done again. Should I be receiving FP notice for renewal or do I need to go thru infopass again?

Hi All,
Now I have some questions regarding the process after getting Visa. I have read threads about airlines and medical insurance on this forum.
I was wondering if someone can shed light on finally what is a good medical insurance to buy, my father is 65 and mom is 60 and both have health issues.
Please let me know which insurance to buy which will cover their international travel plus stay in US
Also, please let me know which airlines are good for parents. I am east coast. My parents will definitely need assistance and I am also looking for someway I can have some travel companion for them. Please let me know if you have any suggestions. Thanks a ton.

Good MOrning All I have 2 questions:
1.) My littel sister is living with a Looser for the past 10 teays and he refuse to file for her Residency. So got pregnat last year and now has a baby by him. Is there anything she can do to get her residency in this situation?
2.) I am married to a US citizen. I have a Pending case with USCIS however it has been draging out for too long. I wanted to file for my Residency using my Current marriage. She is a US citizen however dose anyone know if there is a limit or time frame when a US citizen can file for someone else? She was married before and filed for her X-husband residency. Can she file me now without any problem?

I have the following questions with respect to number of days I can stay out of the country for my situation.
I have been on green card since June 2010.
I have visited India from October 17' 2010 to Feb 4' 2011 (Total 111 Days).
Now I need to go back to India again for around 3 months (Approx 10th May - 10th Aug) which is about 93 Days.
My questions are:
1. As a GC holder can I make the above visits without resetting my 'Continuity of 5 Yeard of Residence' clock ? As in each calender year I will not be out of country for greater than 180 days. But, when you count from October 16 2010 - October 15 2011, I will be more than 180 days out of the country.
2. If answer to the above question is NO, do I need to file/apply for any exception to be out of country?

The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?:confused:

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website.
