You need a visa to enter Canada that can be applied from any Canadian Consulate in the US. Indian nationals in the US without Permanent Residency/Green Card are required to have a valid visa to enter Canada irrespective of their status in the US.

Me and my Wife's i-485 is pening for last one year. EB3-ROW. (PD May 2006). Currently my wife is working with her EAD. Her employer want to apply for her GC also. She will be falling in the EB2-ROW category.
In this situation if she apply for that and take me as a dependent does it going to hurt my current application process? or she can just process her case.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?
Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

If you can get to the soft copy of the checks usually provided by most of the banks, you can find the receipt number on the rear/back side of the check.

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

WASHINGTON - California voters continue to disapprove of Congress even more than they do of President Bush, and for the first time Speaker Nancy Pelosi's ratings are more negative than positive, according to a Field Poll released today.
The poll found that 22 percent of state voters approve of Congress' job performance, with 64 percent disapproving. The discontent was bipartisan, with 70 percent of Republicans, 63 percent of independents and 58 percent of Democrats giving Congress negative marks.
Those findings, taken in a survey of 1,201 voters from Oct. 11 through Oct. 21, track national surveys. A Los Angeles Times/Bloomberg poll during the same period also found a 22 percent approval rating for Congress. A CBS Poll registered a 27 percent approval rating.
Bush earned a 27 percent approval rating from voters in the same Field Poll.
Political analysts give several reasons for the low marks: Democratic voters' dissatisfaction over the inability to change Iraq war policy, Republicans' opposition to Pelosi and other Democratic leaders, and a sense by many voters that Congress can't come to grips with tough issues such as immigration.
"Republican reaction has remained about the same this year, but the real trend is that rank-and-file Democrats and non-partisans are displeased because they expected more from the Democratic Congress," said Mark DiCamillo, director of the Field Poll.
Pelosi, a San Francisco Democrat, earned a 48 percent approval rating in March, two months after Democrats took over Congress. That dropped to 39 percent in August and 35 percent in October, with 40 percent disapproving and 25 percent registering no opinion.
"Iraq is the anchor weighing down Bush," DiCamillo said, "and now it's an anchor on Pelosi because of the complete inability of Congress to change course on the war."
Pelosi and other Democratic leaders held meetings in the last week to find ways to improve their "message" about what they call the New Direction Congress, highlighting such legislation as the minimum wage increase and ethics reform.
Despite the low marks for Congress, Republicans had little to cheer about in the new Field Poll. Voters gave an approval rating of 34 percent to Democrats in Congress, and 20 percent to Republicans.
Only 29 percent of Republican voters in California approved of the GOP performance in Congress, with 53 percent registering disapproval.
"That 2-to-1 disapproval by their own party really jumps out," DiCamillo said. "Republicans in Congress are now playing 'prevent defense' for Bush on the war and on domestic issues, and Republicans in this state do not approve of that."
The state's two senators, Democrats Dianne Feinstein and Barbara Boxer, earned higher marks than Pelosi and Congress overall, but the approval ratings for each senator dropped 10 percentage points since March.
The survey showed that 51 percent of all voters approved of Feinstein's job, with 31 percent disapproving. Boxer's approval rating was 44 percent positive and 35 percent negative.

I have a question. I heard about new premium processing rule for 140.
my friend�s six years is going to complete in next month , he has applied labour certification via PARM 10 months back and its pending, did he is eligible to file 140? Or he has to live next month?
Your friend cannot apply for I140 without approved labour. I don't know what other provision he has to be in status. May be he can try to recpture the vaccation time. If he has atleast 2 months of vaccation time, don't know if he can apply for 7th yr extension based on 365 days rule.

Hi Experts,
My wife is on H4 visa and has started her MS in CS in Jan. She applied for her change of status to F1 visa on 15 th feb. As of today (17th March), her approval notice hasnt come and her H4 is expiring on 31st March. I am not even able to follow her case online on USCIS coz her return recipt number is not updated at all. This is quite common I have heard.
My question is, should we also apply for her H4 extension before 31st of this month so that in case her approval for F1 does not come before her H4 expires and in worst case it gets rejects, she still wont be out of status coz her H4 renewal application is in place or am i just being too paranoid and should just wait for her F1 to come??

Hi,
I am lawful permanent resident of United States, my I-130 is going to be expired on July, 2010, the last time I returned to United States was on October, 2009 and also depart on October, 2009.
I am now planned to return and live in the US for good on September, 2010, however by that time, my I-130 will be expired. Since my last time I left from US was on October 2009 and it is less than one year between the date I am going to return to US for good on September 2010. For this case, should I be fine by just holding just my green card to return to US for good.
Please kindly advise.

I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).
