Fill 131 form, attach a cover letter and AP - you dont need to include the fee as it is a USCIS mistake. Call USCIS 800 number or take infopass appointment before you refile.
Does any one know what is the process if we get wrong name in AP.? as I did get spelling mistake by uscis.

One think people don't get is, whether the current/future job qualify for EB2, It doesn't matter even you have a Phd and the job only requires Bachelor or equivalent then it is EB3, also certain programming jobs doesn't qualify for EB2. First ask your HR for min job requirement!:(

Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.
Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.
Please suggest me the best possible way ...

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question or suggest any other possibilities for rejection?

Conclustion: "This Court finds that the FBI owes no duty to an applicant to process his or her background check. Company A had applied for an RIR Labor app in Oct'2002. In Mar'06 we got a letter saying that case was closed. Then the attorney asked it to be reopened and it was reopened. Then now end of Aug we got the approval.
Im in my 8yr of extension based on this RIR.
Ok since then in early 2004 Company B bought Company A. Then in Mid 2004 Company C bought Company B. Attorney at that time said i dont need to file any H1 and can stay in the H1 from Company A because it was a successor of interest !
but now the attorney is saying that it will be very difficult to prove this is a successor in interest and there is no way we cna get the I140 approved.
So..
1. What do you guys think ? Has anyone gone thru' something like this. Any ideas ? I have also applied for PERM with the current company.
2. How long can I continue without filing I140 for the labor that was approved.

Hi All,
How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

I have got an RFE for my I-485 application. . I missed to complete a question (part3 and question #10) in I-485 form for which I got a request for evidence letter from USCIS. Can anyone has any template on how i should reply. Your help is much appreciated . Thanks in advance

� Company A applied for her GC on 18-Aug-2009 in EB2 while she was still on L2

� She got her L2 stamped from India and entered US on L2 on 03-Jan-2010
