Hi All,
My wife is joining me on a H4. I plan to get her visa converted to H1 and my company is ready to sponsor her visa for conversion. Pls let me know if H4 to H1 visa is a tough thing. And also is there is last date we have to file the papers for this?? is it treated as a regular h1 quota or it lies outside of the quota and can it abe applied anytime??
She has a 16 yrs degree and has work exp which qualifies her for visa.
Thanks

Hi Gurus,
I wanted to know if I can work for H-1B with my current company which holds my H-1B and work outside with another company on EAD. Is there a chance that I may loose my H-1B status if I work with EAD.
Please let me know,
Thanks,

I got labor cert approve on FEB10 and going to apply I-140 via preium process in Mar 15.
My Laber cert was file on April 09 and I have been paid lower than prevailing wage since the company reduce working hour and aset of company is 0
Year 2008
W2 + Net income tax return of company reach required wage
Year 2009
W2 + ballance sheet reach required wage (but net income tax return for 2009 is not availble yet)
Are they going to ask for 2009 net income tax return in March? if my company going to file tax extension this year and I also afraid that the net income in tax return may be lower than the number in balance sheet this year.
Is it posible that My case would be get approve without any RFE?
Thank you so much for your response i have been worried about my case for a while......
pls help

Hello,
I am on an O-1 visa married to a G-4 visa holder working for an international organization. My spouse's work told her recently that her spouse and other dependents have to be on a G-4 dependent visa unless they are a US citizen, green card holder or on their own G-4 visa.
1. If I change to G-4 spouse visa, I would have to wait 4-6 weeks before I get an EAD to work. So, I want to know if this is indeed true.
2. Can I continue to work on my O-1 until I get the EAD? Is there any way to expedite the EAD process.
3. Plus, I want to know about the portability of the EAD I can get through a G-4 visa.
4. Also, would this restrict my ability to apply for a green card in the future.
Thanks in advance for any replies.

Hi guys,
I am adding my wife's AOS application to my own pending AOS application. Because of whatever reasons we couldn't file our apps together earlier.
I notice that I need to give my wife's Alien registration no (ARN) at a couple of places in the application package, such as in the I-485 form, G-325A form, and at the back of the photographs.
Needless to say, my wife does not have an ARN. I was allocated an ARN when my I-140 got approved. Since she is just a derivative beneficiary, she does not have an ARN yet.
So what should I do about these columns in the form. Should I leave them blank, or should I fill them up with my own ARN.
Please help
Thanks
K

I was also in the same boat couple of months back and got two appointments. Technically we can send a letter to USCIS with explanation. But my attorney suggested me to go for the second appointment. So I went twice..

Leave it to comedian Stephen Colbert to send home the point that comprehensive immigration reform - particularly plans to legalize millions of farm workers - will not result in Americans losing jobs. From the AP:In a tongue-in-cheek call for immigration reform, farm workers are teaming up with comedian Stephen Colbert to challenge unemployed Americans: Come on, take our jobs. Farm workers are tired of being blamed by politicians and anti-immigrant activists for taking work that should go to Americans and dragging down the economy, said Arturo Rodriguez, the president of the United Farm Workers of America. So the group is...

One of the stumbling blocks in the behind the scenes negotiations to craft a bipartisan immigration reform bill that also has the support of business and labor unions has been a proposal to create a commission that would basically determine quotas for all employment-based immigration categories. The business community and many Republicans have expressed concerns that the commission would be politicized. Labor unions have not been compromising on this issue and that has caused delays in working out a final deal that will allow Senator Schumer to introduce his bill. According to journalist Jeffrey Kaye, however, a compromise may be...

I also received RFE. It was related to TB chest X-ray. In '07 doctor said, it is not requited but USCIS feels other way.

Could you post the actual percentage of EB legal immigrants. If it is 15% then it is sad. It should be at least 50% in order for the country to have the brightest talent.
Out of 1 million green cards issued every year, 140000 goes to EB immigrants which works out to 14%

My application was filed in EB3 category and PD is current (has been since start of this year). I have an approved I-140 since Feb 07 and the I-485 was filed prior to the mess of 2007. I have taken 4 Infopass appointments trying to find out why is it taking this long to get "a decision". At this point, I don't care what the decision is, as long as there is one so that I can move on in my life. Called and spoke with the processing center that the case is outside their "normal processing time" only to hear, "We are processing". They won't tell me what is going on.

Eritrean-born Meb Keflezighi, who won the New York City Marathon yesterday, is the first American man to win the race in 27 years. Meb came to the US as a 12 year old boy in 1987 as a refugee from his war-torn country and became a US citizen in 1998. He has emerged as one of America's leading long-distance runners since graduating from UCLA. He won a silver medal for America in the 2004 Olympics in Athens, but an injury knocked him out of contention last year. The Athens medal was the first for an American male marathon runner since...
