I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.
Pls who can answer 2 small questions:
1. Do I have a chance to work for this company?
2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

Your passport has nothing to do with you invoking AC21. AC21 is just a way of informing Uscis that you are switching to another job with similar duties, that's all. There's no official form or application to submit.
Just apply for the renewal of your passport as you would usually do. That's all.

Hi,
Currently i am working as full time employee on H1B, receiving W2. I have EAD valid until Oct 2010.
Can i use EAD to work part time and receive 1099 as income statement? If i use EAD / 1099 will this cause an issue for I-485 approval (AOS is pending) ?

I have a approved I-140 with company A. It is a substitute labor.
I am getting laid off end of the month and I have a new offer from company B.
Can I port priority date of this I-140 to new company B? Does porting work for substitute labor also?

my visa , H1b expired, but have applied for H1b extension pending since Mar 2007, but i think as long as we are in legal status inside the country it should be fine - my 2 cents.

BUT I have heared that if she gets some research-work in any University / non-profit organisation, they do give special work permit immediatly unlike H1 where u have to wait till October... IS THIS TRUE?

If we could add some good things for legal immigrants (EB), and the bill gets passed in senate... what are the chances of getting it passed in house and reaching president's table. The reason for this concern is that same thing happened in Dec 05, when at the last moment all immigration stuff was reformed from budget recon. bill. I am sure IV must be thinking about this as well and would like to get IV team's views on this. Also wanted to thank IV team for taking so many efforts.

I am in a weird situation here, I was Laid off on July 21st with pay in lieu until 4th August. I had applied for Change of Status to F2 (my wife is on F1) on 17th August. On 31st August I got a job offer and applied for H1B transfer to USCIS on 8th September (using 15th august paystub as the latest).
At the same time i filed to USCIS to revoke my F2 application.
Today I got a notice from USCIS that my application for change of status to F2 is approved as of 09/21/2009.
Now, I dont know what to do, does it mean I am now on F2? Is my H1B transfer application still valid or I need to apply again this time on premium processing.
What should be my next course of action. Any help in this regard would be highly appreciated.

I just confirmed from my Lawyer that i can go back to my Previous H1 if it is not canceled or revoked by the employer. As simple as that.

I was H1B, but used AP return to the U.S. the same company, but when I filed the new I-9 form after return, the company lawyer asked me to write EAD and EAD expiration date, so I guess I am AOS now? or not? I am not sure. My company will resume my H1B this month, but don't know when it will be completed.

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. Right now they have not even done with July 2nd filers.
Also ppl whose applications have been transfered have not got any receipts.
About the 17th July, i think we should be atleast looking for minimum 15-20 business days.
I will request you to please concentrate on the September Rally. It will bring relief for all of us.
