I recently got my I797 approved (on Oct 19) but, the USCIS denied my extension of stay, and I need to go for stamping in Chennai (as per I797). My question:
1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.

Your friend's wife should be okay. As long as the marriage took place before his I-485 approval he can add his spouse for an AOS or follow to join application even after the approval(within limited time window, of course).
In this case the application was sent before the approval so there should be no problem.

My PD is 08 july 2004. ND 08/09/2009 (NSC) and no approval yet. Multiple SLUD's from 4/2/09 - 04/16/09 on dependents and my cases after we sent response to RFE.
Last update was on 04/16/09.
Opened an SR on 09/03/09 and the wait goes on ...
Its furstrating to see the "Inorderly" and "out of turn" approvals ...
I don't want the miss the boat as PD later than me are using up the numbers.
There must be lots of IV members who are in similar situation.
Attorneys please suggest how we should tackle this.

Hi,
Can we apply for a new EAD/AP after they expire?
If so, what is the difference b/w applying for an extension vs. a new one in terms of fees/documents/photos/etc.?
The reason being I already spent $1000 for EAD/AP last yr. but never used it, and now I have bear all H1 (extension) expenses as well as employer sucked all my blood & is after my limbs after 8 years of slavery. On top of that has stopped paying salary since April.
Hence I am trying to cut corners whenever wherever possible. Any responses or help greatly appreciated.

I was wondering if there is a way to efile for renewal of EAD & AP or do we really need a lawyer. It is turning out to be too expensive to file for a renewal through my comany lawyer. If it is possible, can someone who has already self filed advise of the procedure?

Hi
My 485+140 is currently with my lawyers for filing.
In the meantime, my wife's dates went current. Her lawyer says it is ok to apply her 485 and it is preferred so we have a backup.
However, BCIS might get confused and ask us to pick one 485 at a later date - but the lawyer advises to file it now and face it later.
1) Has anyone does this?
2) Should my wife apply EAD and AP as well or just 485?
3) What are the problems I should expect?

Dear Attorney,
My I140 got approve from A company when I was working in company B.( I applied for I140 from company A and left the company after 5 months due to some reason). My approved I140 is still valid as I went to USCIS website and check the case status using EAC number.
This is my 5yr on H1 visa.
My question is:
- Can I transfer my H1 to company C using A company I140 EAC number and get 3 yrs of extention? ( I only have EAC number of approved I140. A company have refused to give me copy of approved I140 as I left the company.).

I appeared for h1b stamping at new Delhi us embassy. VO kept my passport and forms for admin processing. VO told me it may take 2-4 weeks. they didn't give me any slips ( pink/yellow/green). I am not sure what kind of processing they wanted to do in my case

I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.
Will I get visa stamping with
1. Copy of I797A and Employee's related documents ?
2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?
Please guide me Immediately.
