Please be aware that W2s at 140 stage are mainly asked to judge the "ability to pay" of the employer. There can be other reasons too.

I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

Hi All,
I'm looking for solutions in my situation.
I'm currently under a L1 visa for a company A but I would like to resign and look for another Job.
The thing is, as far as I understood, If I resign I have to leave the US. So here are my questions:
1) How long can I stay in the US after I resigned from my company under a L1 visa? Can I stay in the US even if my I-94 is valid?
2) How is the USCIS notified that I resigned from my company? Should I send a notification or is that done by my company?
3) Can I apply to a H1B COS by myself to then look for a job? Or will I need a company B to sponsor me?
4) If I can't apply to a H1B COS by myself, do I have any other visa options?

what type of cases, you meant ?
I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.

You will be able to move to a different employer with better job with better pay. If you are happy with ur current job still it cant proect you if ur current employer gors out of business and fires you.

Hi,
My H1(second term) expires in December 2009. I was out of the US for more than a year and resumed my job in jun 09. My employer will be filing for H1 extension in October 09.
I have an approved I-140.
If my H1 extension gets rejected, will that affect my green card process ? If H1 extension gets rejected and if I switch to EAD, will the H1 rejection affect green card processing ?
Please Help.

The Senate approved a stop-gap spending bill that will allow the Department of Homeland Security to operate until the end of October while House and Senate conferees try to work out a final version of the agency's spending bill. Hi,
My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.
We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.
I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).
Any advise would be appreciated.

I came to US on a L1 Visa, changed jobs got a H1 visa but never left the country for the last 3 years so dont have a H1 stamping in my passport.
I will be getting my 7th year extension (probably 3 yrs based on my approved I-140) soon and i have to visit India atleast this year. With no hopes of 485 filing and absolutely no hopes for CIR i need to plan to get a Visa stamping in my passport.
With the Interview dates at US Embassy in Chennai already gone till December First week, do you know whether i can get my H1 stamping done in any of the Canadian Embassies?
Has anybody whose case is similar to mine got their stamping done in Canada? Advice me on any risks.

I had breakfast today with a few advocates and an Obama Administration official who noted that the immigration summit will now be held on June 25th. Encouraging. I also learned that the current expectation is that the immigration reform bill will likely start in the Senate and that Senator Reid is hoping for reform legislation to be considered in the fall.

We filed a H4 to H1 Change of Status petition for my wife. The file was opened and processed by USCIS and a RFE was issued. Due to some family situation, we had to withdraw the H1 petition instead of replying to the RFE.
My question is: Is the security/anti-fraud fee ($1500) returned by USCIS in such cases. We applied through a big consulting company.
