    Just i have applied for AP through efile. From here what's the procedure? Do i need to send the support documentation? if so, what are all the documents i need to send? please through some light on this. also will i get another bio metrics appointment?


    with addition to above my questions, do i need to get stamped to maintain my H1 status? or will it be okay if enter thro' AP and working for my same employer to maintain my H1 status?

    Sorry for posting this question again. but since I did not get an answer, I am posting again to see if some one can advise regarding this. I am trying to look up dates for H1 visa stamping in Canada and the website says no appointments for 6 weeks. I am thinking of going for visa stamping in July. is there any chance that they might open up some more appointments in the next few days even though it says unavailable currently? please post your comments and experiences regarding this.

    I filed 485 last july and want to file EAD now. I had FP done last year. If I do efiling for EAD will I have to go to ASC for photos. I saw in other posts that they have linked Biometrics but what abt the photos ?

    eFiling EAD will result in ASC appointment for code 2 biometics (Finger Printing of right Index finger + photo). You need to take the appointment letter and one form of photo id (passport or drivers id).

    I had my ASC apt. for eFiled EAD last week (Feb. 12th).

    Hi All,

    Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.

    On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

    Conclustion: "This Court finds that the FBI owes no duty to an applicant to process his or her background check. Absent a duty to the applicant, neither the Mandamus Act nor the Administrative Procedures Act confer jurisdiction on this Court over the FBI. Without an independent basis for jurisdiction over the FBI, and since the Declaratory Judgment Act does not confer jurisdiction, this Court is without subject matter jurisdiction to review any decisions or actions of the FBI regarding its processing of a background check for CIS that is related to immigration matters."

    It seems that suing FBI becomes ineffective now.

    Hello All,

    I've been reading a lot on these forums about guys asking where to send 485 applications to. While my I-140 got approved from Texas center (originally filed at Nebraska center) , my lawyer still sent my 485 application to Nebraska center. I think, he has made a correct decision since, 485 form mentions that all employment based applications should be sent to Nebraska center. Please correct me If I am mistaken.

    Secondly, the application fee can be in the form of personal check made payable to USCIS or Department of Homeland security. I've made checks payable to USCIS - does any one know if the check has to say "USCIS" or should it say "United States Citizenship and Immigration Services"? I would think just "USCIS" would suffice.

    Any light shed on these two points would be greatly appreciated...

    Thanks. But I heard if they find something critically wrong on 485 form, they may reject it and return it in as long as 3 month! Why can't they just make sure the forms are OK and then start the name check?

    I130 petition shows an "immigrant intent" so that could come up as a ground of not allowing a person into the U.S. on a purely non-immigrant visa. I would suggest to speak to an attorney.

    Hello All,

    I received a "Notice of intent to Revoke " on my approved I-140 recently. By gods grace, my company was able to get my I-140 reaffirmed.

    The status on the USCIS website states as follows.

    ".....we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly."

    We did NOT request for consular processing. Does any one know why USCIS send my case to Department of State?

    My h1b expires of 09/30/2010.
    my drivers license expires on 5/31/2010.
    I have ead that expires in jan 2011.
    my h1b extension will be filed around june 2010.
    can I use ead card to renew my drivers license till jan 2011.
    around jan 2011 I could use extended h1b to renew my drivers license.
    Can I do this. All I want to use my EAD card is for drivers license renewal.

    Hi, I was in India when my husband applied for my H1B in 2008. I got it picked in lottery and got the approval too. I came to US on H4. After Oct 1st 2008, we applied for Change of Status to H4 to legally complete the work permit process. In the Change of Status applicatin form, my company accidently did a mistake of mentioning that Current status=H1B, New status required=H1B. :mad: USICIS, on seeing the application, took a decision to give me H4 with new I-94. I tried calling the USCIS helpdesk, but in vain. :confused:

    1) Now what should I do to start working in H1B?
    2) Was I correct in ging throughChange of Status? Or could I start working with the approval copy I had?
    3) Could I apply for SSN with the 2008 approval copy?

    Any answers would be greatly apprrciated!. Thanks in advance........
